Video Transcript: What Should I Do If I’m In a Car Accident?

Immediately after a car wreck, first asses yourself for critical injuries. If that’s the case, stay put, don’t move, call 911 ask for help. However, if you are able to get out of the vehicle, you should.

If you have a smartphone, get it out. First thing you want to do is take photographs of all vehicles involved in the accident, including their license plates. Make sure to capture all property damage for every vehicle involved in the wreck.

Next thing you want to do is look for witnesses. They might not be people that walked right up to the scene, if so it’s easy. But they might be across the street in their yard. They might be across the intersection at a gas pump. They might be a store employee in a doughnut shop. I know it’s a hassle, but you’ve got to go over to those witnesses, turn your recorder function on in your smartphone, and get their statement for what they saw.

The next thing you want to do is to go over to the person that caused that accident. Have your recorder on and say, “Hey, what’s your understanding of what just happened?” That could save you a big hassle and big headache later on, when it goes to the insurance company. You also want to make sure not to talk to the insurance company until you’ve first spoken to an attorney.

Almost every personal injury law firm, mine included, offers free consultations. So, call a law firm up first, talk to them before you talk to the insurance company. If the insurance company is calling you, it’s ok to talk to them about not how the car wreck happened and not about what your injuries are, but it is ok to talk to them about saying look, I need you all to fix my car and look I need a rental car. Those things are ok to discuss, but don’t talk about how it happened and what your injuries are.
