It sounds counter-intuitive, but the key to settling personal injury cases for more money is a car accident attorney’s ability try such cases in Michigan courts. This is according to Steven Gursten, partner of Michigan Auto Law, a leading law firm in the state exclusively handling car, truck and motorcycle accident personal injury cases for more than 50 years.

In this video, Gursten explains how No-Fault insurance companies and defense lawyers know which car accident attorneys have outstanding trial records. This determines whether a personal injury victim will receive a fair settlement offer from the insurance company (that does not want to face a good car accident attorney in court) or a very low settlement offer. Gursten insists that people suffering personal injuries from car accidents must research their prospective attorney’s trial record — as it makes a huge difference between a mediocre settlement and an outstanding one. Here’s what Gursten has to say: “Hi I’m Steve Gursten, and this is my first tip on how to settle cases for more money for personal injury lawyers and car accident lawyers. This is taken from my seminar that I did for the Michigan Association for Justice in June 2010. The most important tip to settle cases for more money is that you have to try cases.

This is because some insurance companies will make very unreasonable settlement offers and play hardball because they want to see what a personal injury lawyer will do. With the computers and verdict reporting software that’s out there, it’s really easy for an insurance company or a trucking company to do a verdict search on a lawyer and a law firm, to find out about that lawyer’s reputation, and his willingness to take cases to trial. So they can find out pretty quickly if it’s been 15 years since that lawyer has tried a case. From that, the insurance companies know whether to play hardball, or whether they should settle faster and for more money. And if a lawyer doesn’t take cases to trial, or have a reputation for being willing to take cases to trial, that insurance company knows that it can always settle that case cheap.

So if you’re a client out there, and you’re researching a potential lawyer to represent you, the most important thing for you to know is really, a firm’s trial reputation. The insurance industry knows it. It’s really the key to getting a better settlement and a faster settlement. If the insurance company and the people on the other side already have that information, I guess the question is, “Shouldn’t you also?””
